Welcome to SiteInspector-Net (hereinafter referred to as "the Platform"), operated under the registered domain AciGadgets.com, owned by Automática y Computación Industrial ("ACI", "we", "us," or "our"). By accessing and using our services, you agree to comply with and be bound by the following Terms of Service. If you (hereinafter referred to as "the client") do not agree to any of these terms, we recommend that you refrain from using the Platform.

2. Service Description

SiteInspector-net is a platform designed for the planning and execution of inspection visits, focusing on tracking the progress of civil works within the construction industry and conducting property appraisals.

3. Use of the Service

To use the Platform, the client must be at least 18 years old and possess a valid Google account for various authentication purposes.

b. Account Registration and Security

The client is responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. The client must promptly notify us of any unauthorized use of their account.

c. License to Use

With a valid and current subscription, we grant a limited, non-exclusive, and non-transferable license to access and use the Platform in accordance with these Terms of Service.

4. User Responsibilities

The client agrees to use the Platform solely for lawful purposes and in compliance with all applicable laws and regulations.

The client is responsible for any content they upload, submit, or otherwise transmit through the Platform. The client must not share content that is unlawful, defamatory, obscene, or infringes on third-party rights.

All intellectual property rights related to the Platform, including but not limited to text, graphics, logos, and software, are owned by ACI or its licensors. The client is granted no rights to these materials except as expressly stated in these Terms of Service.

We may suspend or terminate the client’s access to the Platform at any time, without prior notice, for violating these Terms of Service, failing to make payments, or for any other reason at our discretion.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted, error-free, or secure. We will not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Platform. We are not responsible for internet signal issues during report updates or file uploads.

12. Governing Law and Jurisdiction

These Terms of Service will be governed by and interpreted in accordance with the laws of Guatemala, without regard to conflict of law principles. However, if the laws of the client’s country of residence prohibit the selection of foreign law for certain matters, local laws may apply as required.

In the event of disputes, controversies, or claims arising out of or related to these Terms, binding arbitration will be administered by the International Chamber of Commerce (ICC) under its Arbitration Rules, with the seat of arbitration in New York City, United States. If the parties reach a conciliatory agreement or preliminary hearings are required, all travel, accommodation, and other reasonable expenses incurred by ACI (including travel fees) will be borne by the client unless otherwise determined by the arbitral award.

For clients in Guatemala, Central America, the Caribbean, or Mexico, disputes may be resolved in the competent courts of Guatemala City, Guatemala, if agreed upon by the parties. In such cases, the client will also cover the provider’s travel and accommodation costs to these regions.

By using this Service, the client accepts these provisions and waives any objection based on jurisdiction.
